Premise

Dear customer, we invite you to carefully read these conditions of sale (hereinafter also “CDV”) before proceeding with the purchase of products through the site https://zorzoliorologi. com/


These conditions of sale regulate the remote sale, through the Zorzoli Alessandro website, of the products available for sale in the specific catalogue viewable on the website https://zorzoliorologi. com/ (hereinafter also the “Site”).

The company, as defined, is hereinafter referred to as (“Zorzoli Alessandro”).
Distance selling means purchase requests that the customer visiting the Site (hereinafter also “Customer”) may send to Zorzoli Alessandro via the Site itself.

Please remember that it is the Customer's sole responsibility, before submitting the purchase request, to read and accept these GTC, the text of which will always remain available and accessible to the Customer on the Site https://zorzoliorologi.com/


These CDV apply equally to private consumer Customers and business Customers, but do not apply to purchase and sales contracts stipulated at the store in Pavia, Piazza Petrarca 16. Sales are reserved for Customers who have reached the age of majority. Minors do not have the right to legitimately stipulate a contract and are required to use a parent or legal guardian to send a purchase request in their name and will in any case be required to accept these Conditions of Sale.

All product images published on the Site represent exactly the final product that the Customer can purchase.

Some objects may appear slightly larger or smaller than actual size in order to fit the object to the screen or due to particular photographic techniques.

The colors in the images may be affected by the lights of the photographic set, reflections of other objects or the settings of the screen displaying the images in digital format. Zorzoli Alessandro takes the utmost care to ensure that the information describing the products on the Site is accurate and complete. However, we do not provide guarantees, explicit or implicit, in relation to the accuracy, reliability and completeness of said information.

Before forwarding the purchase request, the Customer must declare, by clicking on the appropriate button/flag, that he/she has read all the information provided during the purchase procedure and accepts the Conditions of Sale. Pursuant to and for the purposes of articles 1341 and following of the civil code, the Customer therefore declares that he/she expressly accepts what is reported therein. Failure to declare does not allow the Customer to forward the purchase request via the Site.

Once the purchase procedure has been completed, the Customer will keep a copy of these Conditions of Sale and any order confirmation communications, in compliance with the provisions of articles 50 et seq. of Legislative Decree no. 206/2005 on distance selling and articles 12 et seq. of Legislative Decree no. 70/2003 on electronic commerce.

Zorzoli Alessandro may make changes to these conditions of sale from time to time, at its sole discretion or following subsequent provisions of law; updates will be made known to Customers by publication in the conditions of sale section on the site https://zorzoliorologi.com/ . Such changes will be applicable to purchase requests sent by the Customer after the date of publication of the changes themselves on the site, and will not have retroactive effect.

Order online

On the Site https://zorzoliorologi.com/ The Customer can order different products. The products may be immediately available or obtainable in a short time. By sending the order, the customer undertakes to purchase the product at the price displayed online if available. Orders sent via the Site are subject to the relative availability of the product, which may also be available at the same time for physical sale in Zorzoli Alessandro boutiques or not present in stock. The order procedure on the Site is completed with the purchase request by the Customer and with the consequent acceptance by Zorzoli Alessandro with explicit confirmation also with reference to the price.

Purchasing procedures

To purchase one or more products the Customer must log in to the Site and register.

By sending the order via the Site, which has the value of a contractual purchase proposal, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and that he fully accepts these GTC.

Zorzoli Alessandro sends confirmation of receipt of the request to the Customer and takes charge of it, but this does not constitute acceptance of the Customer's purchase proposal; with it Zorzoli Alessandro only confirms that it has received the purchase request and has subjected it to a data verification process and the availability of the requested products.

The sales contract must be considered concluded when the Customer receives from Zorzoli Alessandro a separate and dedicated email accepting the purchase request, which will also contain the CDV, the delivery times of the goods, the costs and conditions of transport as well as the confirmation of the price.

At the same time, Zorzoli Alessandro will provide the Customer with the bank details to proceed with the payment of the amount due for the purchase of the chosen product. The Customer undertakes to make the payment within two working days of receiving the acceptance email.

Zorzoli Alessandro will verify the credit on the bank account of the transfer prepared by the Customer, which must take place within three working days of its execution. Failure by the customer to pay, within the times and methods set out above, determines the termination of the sales contract.

Zorzoli Alessandro communicates the collection to the Customer and requests the following necessary data and information: for invoicing the product, for legal purposes for the sale of used and/or precious objects, upon delivery/shipment of the product. The Customer guarantees the accuracy and truthfulness of all data and information provided to Zorzoli Alessandro. No responsibility can therefore be attributed to Zorzoli Alessandro if the incompleteness and/or inaccuracy of the data makes it impossible to proceed with the supply of the requested products.

Following receipt of such data, Zorzoli Alessandro informs the Customer that the product is made available for delivery or is ready to be shipped.

Prices and payment methods

The prices displayed on the Site at the time of the order apply to the Customer and must be confirmed in the acceptance email.

All prices are in Euro and are net of: value added tax if applicable; shipping costs and any customs charges.

For all products in the watch sector, if the price displayed online has been erroneously entered, as it is more than 10% lower than the average market price of the product, Zorzoli Alessandro reserves the right to propose a price consistent with the market value of the product to the Customer or to not accept the purchase request forwarded by the Customer, even if the product is available. The average market price of the product is conventionally defined as the average price of the product for the last 3 months on the website specializing in the sale of watches www.chrono24.com .

The payment method provided for online purchases is bank transfer. Other payment methods may be agreed between the parties.

Shipping and delivery

Pickup at the store in Piazza Petrarca 16, Pavia is always possible as long as the Customer specifies this wish. Zorzoli Alessandro notifies the Customer when the product is “ready for delivery”.

Alternatively, Zorzoli Alessandro will ship the product to the Customer at the address provided by the latter.

Unless otherwise specified, shipping costs are the responsibility of the Customer.

Shipping takes place in all EU countries and non-EU countries unless the shipping order is accepted by our partners specializing in the transport of valuables.
The shipment of products sold by Zorzoli Alessandro takes place through delivery platforms specialized in security vehicles with insured transport (Ferrari SPA, Malca Amit, etc.).

Each shipment will be insured for the full value paid by the Customer, who therefore does not run any economic risk for the shipment of purchased items.
Since these are valuable items, for the protection of the Customer, the delivery of the ordered products will take place exclusively at the address indicated by the Customer and physically to the person whose identity document was provided or to a formally delegated representative (concierge, doorman, receptionist, security personnel, domestic staff, relatives or in-laws, official or person residing at the indicated address). Under normal operating conditions, the carrier will contact the Customer to communicate the time of delivery.

Zorzoli Alessandro provides the Customer with the expected time for delivery of the goods shipped, but cannot in any case be held responsible for any delays or failure to deliver due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier of the goods.

Upon receipt of the purchased product, the Customer is required to check whether: the number of packages delivered corresponds to that indicated on the transport document; whether the packaging is externally intact.

If the Customer, at the time of delivery of the goods, certifies that the sales packaging is not intact or damaged, he/she is required to sign the courier's delivery receipt by adding the wording "Accepted with reservation", in order to obtain the possible repair or replacement of the products contained therein (if actually damaged during shipping), after returning them to Zorzoli Alessandro in their original packaging, according to the methods and terms indicated below in the "Warranty" paragraph.

Acceptance of the delivered products without the Customer having made a reservation or dispute about the delivery in the transport document is equivalent to recognition of the conformity of the delivery to the order in terms of quantity, type and packaging.
Please note that the product damaged following shipment will be accepted by Zorzoli Alessandro and replaced, where possible, with an identical product, if all the following conditions are also met: the sales package must be intact and complete in all its parts; the damage must not be attributable to improper use, therefore there must be no tampering, scratches, or missing parts; the product must be accompanied by a document where the damage to the product is contested.

Any additional guarantees provided by current legislation in relation to the products delivered remain unaffected.

Consumer's right of withdrawal

Pursuant to Legislative Decree no. 206/05, the Consumer who purchases one or more products through remote communication techniques can exercise the right of withdrawal without any penalty and without specifying the reason.

This right is reserved exclusively for “Consumer” Customers and therefore cannot be exercised by legal entities and natural persons acting for purposes related to any entrepreneurial or professional activity they may carry out.
All customized, modified or commissioned products are an exception (such as a ring made to the customer's size, a watch engraved on request); for such products the possibility of refund and/or return is not applicable or effective.
The Consumer must exercise the right of withdrawal by sending a communication to Zorzoli Alessandro within 14 days from the day following the date of receipt of the product.

The Customer must return the purchased product within 14 days from the date of the withdrawal communication, carefully packaged and shipped at his own expense. The deadline is considered respected if the customer sends the goods back before the expiry of the 14-day period.

In procedural terms, the customer must send, within the deadline indicated above, a written communication to the email address: info@zorzoliorologi.com certifying the specific desire to exercise the right of return on the purchased product.

After sending the written communication of withdrawal, the Customer must arrange for the shipment of the product carefully packaged and complete with all accessories and everything originally contained. The package must be sent to the following address: Zorzoli Alessandro, Piazza Petrarca 16, Pavia, 27100 (PV), Italy.

The shipment, until the receipt of the goods at the headquarters of Zorzoli Alessandro, is under the complete responsibility of the Customer. Zorzoli Alessandro is not responsible in any way for damage, theft or loss of products that occur during the return shipment by the Customer. It is therefore advisable to organize an insured shipment.

Zorzoli Alessandro suggests entrusting the shipment to a specialized security carrier and is available, upon request of the Customer, to provide contacts relating to its suppliers in this area.

Upon receipt of the shipment, Zorzoli Alessandro will video record the opening of the package containing the returned item in order to document the conditions of receipt of the package, the item and the accessories and reveal any damage not caused by Zorzoli Alessandro or tampering or replacements with counterfeit products.

Once the checks on the condition of the product have been completed, acceptance of the return will be communicated to the Customer by sending a confirmation via email within seven working days of receiving the item at the indicated destination.

The refund will include the full value of the returned products. The only costs due by the Customer for exercising the right of withdrawal are the shipping costs incurred for returning the products to Zorzoli Alessandro, which will not be refunded.

The refund will be paid to the Customer within 14 days of the communication of acceptance of the withdrawal.

Legal guarantee

All products offered for sale on the Site are covered by the legal guarantee for defects of conformity existing at the time of delivery of the goods and not attributable to improper use of the product by the Customer, pursuant to articles 128 -135 of the Legislative Decree. . n. 206/2005 (24 months for new products, 12 months for used products).
The above guarantee is reserved for "Consumer" Customers. Therefore, it applies only to Customers who have made the purchase through the Site for purposes other than any entrepreneurial, commercial, artisanal or professional activity they may carry out.

Those who have purchased on the Site and who do not have the status of "Consumers", in the sense specified in art. 3 of Legislative Decree no. 206/2005, will be subject to the guarantees provided for defects in the item sold, the guarantee of promised and essential quality and the other guarantees provided for by the civil code in articles 1490 et seq., with the related terms, forfeitures and limitations.

The warranty period starts from the date of delivery to the Customer. To benefit from the warranty, the Customer must keep the tax documentation that he will receive and the DDT proving the date on which he acquired the material availability of the product.
Pursuant to art. 132 of Legislative Decree no. 206/2005, the lack of conformity must be reported to Zorzoli Alessandro, under penalty of forfeiture of the guarantee, within 2 months from the date on which it was discovered, by giving notice to the email address: info@zorzoliorologi.com


In the event that the Customer is a natural or legal person who cannot be classified as a “Consumer”, articles 1495 and 1511 of the Civil Code will apply, therefore for the legal guarantees to be effective the defect must be reported within 8 days from the date of delivery or, in the event of a defect not immediately detectable according to the criteria of ordinary diligence, from the date of discovery of the defect.
In the event of a lack of conformity reported within the terms, Zorzoli Alessandro will, at no cost to the Customer, restore the conformity of the product through repair.

Without prejudice to the provisions of art. 130, paragraph 7 of Legislative Decree no. 206/2005, for “Consumer” Customers only, in the event that, for any reason, it is not possible to restore the conformity of the product under warranty or provide for its replacement with an identical product, Zorzoli Alessandro will proceed to refund the entire amount paid by the Customer for the purchase of the goods or, at the Customer's request, to replace it with another available product, with similar characteristics and of equal value.
If, following the checks carried out by Zorzoli Alessandro, the defect does not result in a lack of conformity in the sense specified by art. 129 of Legislative Decree no. 206/2005, it will not be possible to apply the legal guarantee and, consequently, any repair and shipping costs will remain the responsibility of the Customer.
In cases where the application of the guarantees requires the return of the product, it is always necessary that the goods are returned to Zorzoli Alessandro in the original packaging, complete in all its parts.

To avoid damage to the original packaging, during shipping we recommend using packaging that prevents any type of transport damage and we remind you that in all cases the application of labels or adhesive tapes directly on the original packaging of the product should be avoided.

In any case, Zorzoli Alessandro assumes no responsibility for losses caused by improper use of the product or its functionality, or for any indirect, special or consequential loss or damage arising from the restoration of the product's conformity.

Zorzoli Guarantee

All watches offered by Zorzoli Alessandro are scrupulously checked for condition and originality before being put on sale. A first check is carried out by the purchasing manager when the watch is acquired, a second more detailed check is carried out by the expert laboratory technicians, who meticulously check the total originality of the internal components and the proper functioning of the watch. In cases where it is necessary, the watch is subsequently completely overhauled and aesthetically treated. This pre-sales watch verification process guarantees the Customer a safe and transparent purchase of a product free from defects and compliant with its characteristics and peculiarities.

Zorzoli Alessandro offers the customer a 12-month guarantee on each purchase made; this guarantee, which covers exclusively any mechanical damage that the watch may show, is to be considered additional to the official manufacturer's guarantee in the event that the latter is still in force.

The Customer will therefore be fully guaranteed: if the purchased watch is still covered by its parent company, the Customer can take it to a certified center for assistance or go to our headquarters, delegating Zorzoli Alessandro to contact an authorized center; if, however, the purchased watch has an expired official warranty or a warranty extract, the customer can take it to Zorzoli Alessandro who will provide assistance internally or through specialized centers with which it collaborates directly.

The Zorzoli Alessandro guarantee does not apply in the following cases: physical damage to the watch such as damage to the glass, case or bracelet (in such cases the shop will take care of carrying out repairs at favourable conditions but the interventions will not be covered by the guarantee); tampering by third parties; damage caused by improper use of the watch, by its carelessness or if the watch itself has been subjected to interventions by technicians and/or laboratories and/or service centres other than those of Zorzoli Alessandro or those expressly indicated by the company; further damages caused deliberately by the Customer.

Zorzoli Alessandro undertakes repairs that can be solved by its own specialized personnel. This includes in particular the repair or replacement of defective parts and the adjustment and registration of the watch and individual parts. Repairs by the manufacturer are generally excluded from the warranty.
There is no obligation to provide a guarantee if it is proven that the spare part is not available for reasons beyond the responsibility of Zorzoli Alessandro or if the manufacturer does not supply the spare part.

Zorzoli Alessandro is also not obliged to provide warranty services if the provision of the services is impossible.

Zorzoli Alessandro has the watch collected from the Customer and sends the watch back to the Customer after technical assistance. The transport is carried out as insured transport of valuables. The related costs are borne by the Customer. The latter may, at his own discretion and risk, select another shipping method for transport to Zorzoli Alessandro.

The warranty ceases in the event of resale by the purchaser.

The Customer must provide proof that the goods delivered are actually the goods purchased from Zorzoli Alessandro. The goods sent in error will be immediately returned.

Consumer's right of withdrawal

Retention of title

The goods remain the property of Zorzoli Alessandro until the price has been paid in full and the relevant sales invoice has been issued. Before the transfer of ownership, the pledge, seizure, sale, treatment or transformation of the product by the Customer.

Dispute Resolutions and Final Provisions

The sales contract between the Customer and Zorzoli Alessandro is deemed to be concluded in Italy and governed by Italian law. For the resolution of any dispute arising from the conclusion of this distance selling contract, the competent Court will be that of the place of residence or domicile of the Consumer, as defined pursuant to art. 66-bis of Legislative Decree no. 206/2005. In the event that the Customer is a person other than the Consumer, the exclusively competent court for any dispute that may arise in relation to the sale is the Court of Pavia. The Customer retains the right to resort, in the event of a dispute, to an extrajudicial settlement body (ADR), also operating electronically, pursuant to art. 19 of Legislative Decree no. 70/2003. For anything not referred to in these General Conditions, express reference is made to the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) – which in articles from 51 to 68 regulates distance selling – as well as the specific legislation on e-commerce and the general provisions of the civil code on sales, where applicable.
